Without a Lasting Power of Attorney (LPA) your family and friends will not have legal authority to manage your affairs on your behalf. Having an LPS in place will avoid the need to apply to the Court of Protection for a deputyship order, which can be expensive and time consuming.

The changes in the law in 2007 created two types of Lasting Power of Attorney

  1. Property and Affairs LPA Decisions an Attorney could make on the donor’s behalf:
    • Buying or selling land
    • Paying bills
    • Selling shares
    • Claiming benefits

  2. Personal Welfare LPA Decisions an Attorney could make on the donor’s behalf:
    • Consenting to or refusing treatment
    • Where you should live
    • Your day to day care
    • A personal welfare LPA may be beneficial where there may be a family dispute.
